Criminal Justice Act Administrative Attorney

The incumbent will perform the following administrative functions related to the Criminal Justice Act (CJA) and the management of criminal appeals:
reviewing and approving CJA payment vouchers and funding authorization requests for the Court of Appeals; managing the appointment, substitution, and withdrawal of counsel in criminal and habeas corpus appeals; conducting case management conferences in complex criminal appeals; managing pro se filings in counseled criminal appeals and requests to proceed pro se; and resolving requests related to sealed filings in criminal appeals. The incumbent will also work with the Circuit CJA Unit to develop and update processes and procedures relating to the Circuit's CJA Plan (Ninth Circuit Rule 4-1). Representative Duties Manage the appointment, continuation, substitution, and withdrawal of counsel in criminal and habeas corpus appeals. Process pro se motions in counseled criminal and habeas appeals. Make recommendations on motions to proceed pro se in criminal appeals. Conduct case management conferences in complex criminal appeals in order to maximize available CJA resources. Review and analyze CJA payment vouchers submitted by attorneys, experts, and other service providers to ensure (1) accuracy and compliance with national and circuit CJA guidelines and policies, and (2) that time expended is reasonable and (if applicable) within budget, consulting as needed with the Circuit CJA Unit about significant issues or reductions. Approve CJA payment vouchers on behalf of the authoring circuit judge if the case was submitted to a merits panel or the appropriate administrative judge if the case was resolved before submission to a merits panel. Review and approve requests for interim payments, authorization for expert and other services, non-court travel, appointment of associate or co-counsel, and Government Travel Account vouchers. Meet with CJA panel attorneys to resolve disputes on specific vouchers. Process motions and notices relating to sealed material in criminal and habeas corpus appeals. Work with Circuit CJA Unit to develop and update voucher processing procedures, CJA resources, and guidelines for implementing the Circuit's CJA Plan. Provide guidance and consult with panel attorneys in response to questions, problems, or issues. Develop, implement, and communicate new policy changes to panel attorneys, including ensuring CJA information on the Court of Appeals website is accurate and up-to-date. Supervise administrative staff. Other duties and projects as assigned. Required Qualifications Qualifications for CL-29:
Juris Doctor degree (or equivalent) from an accredited law school. At least two years of specialized experience, including at least one-year equivalent to work at CL-28. Admission to practice before the highest court of a state, territory, commonwealth, or federal court of general jurisdiction. Thorough understanding of the Criminal Justice Act as well as criminal law and procedures as practiced in federal court. Qualifications for CL-30:
All the above including:
At least three years of specialized experience, including at least one-year equivalent to work at CL-29. Preferred Qualifications Experience in federal criminal defense representation, preferably on appeal. Knowledge of attorney billing practices and staff management. Ability to apply existing CJA policies and procedures and recommend new procedures to address unique or challenging situations. Required Competencies Ability to consistently demonstrate sound ethics and good judgment. Excellent oral and written skills, and the ability to communicate with individuals and groups to effectively provide information. Ability to answer procedural questions without providing legal advice. Ability to deal persuasively and tactfully with counsel and develop creative and practical solutions. Ability to handle sensitive information and maintain strict confidentiality. Proficiency in MS Office products, including Word and Excel. Experience with eVoucher and CM/ECF preferred.

The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
